OpenAI loosened ChatGPT's advertising rules in April so medical, legal, and financial advice contexts were no longer categorically blocked from ads by default. Marketing Brew identified the change by comparing the current policy with an April 29 archived version and reported that OpenAI may manually approve some advertisers in financial services, healthcare and medicine, and legal services on a case-by-case basis.
The change does not mean ads are broadly available across sensitive conversations. OpenAI spokesperson Taya Christianson told Marketing Brew that the company was not widely including ads in financial, legal, or medical conversations. She cited general exercise or diet queries and broad questions about budgeting or financial education tools as examples of contexts the company may consider non-sensitive.
Search Engine Journal's review of the more detailed current rules found an important distinction: some health and finance advertisers may qualify after review, while most ads for legal services remain prohibited except for general legal education.
How ChatGPT advertising works
OpenAI's current help documentation says ads may appear for users on the Free and Go plans, while Plus, Pro, Business, Enterprise, and Edu accounts do not receive ads. The company also says it does not show ads to accounts identified as belonging to people under 18.
OpenAI describes ad placements as clearly labeled sponsored content, visually separated from the response, and placed below the end of a response. It says ads run on systems separate from the chat model and that advertisers cannot shape, rank, or alter ChatGPT responses. The documentation also says an ad display does not constitute OpenAI's endorsement of an advertiser or its products.
The help page separates advertiser eligibility from placement context. It says some health and financial-services advertisers may be eligible under strict criteria, but ads remain ineligible near sensitive user content, including personal-health and mental-health conversations.
Policy changes create planning uncertainty
Search Engine Journal reported that advertiser eligibility rules changed four times between March and August. It summarized an SE Ranking test of 50,006 commercial prompts in the United States collected on July 23. ChatGPT showed ads on 28.69% of prompts classified as healthcare, compared with 2.64% in a separate Google AI Mode study. Because the studies used separate prompt sets and measurement windows and did not publish the complete prompt lists, that comparison is directional rather than a platform-wide delivery rate or evidence that sensitive-context safeguards failed.
The distinction between placement rules and advertiser eligibility is operationally important. An advertiser may qualify for the program while a particular conversation remains unsuitable for an ad. In regulated categories, campaign reviews therefore need to account for both the seller's category and the user's context.
For marketing and measurement teams, frequent policy revisions create a version-control problem. Campaign experiments, brand-safety assessments, and prompt-based visibility studies can become stale when category eligibility or contextual restrictions change. Evaluating ChatGPT as an acquisition channel requires recording the policy version, geography, account tier, prompt category, and measurement date alongside observed ad frequency.
