A Munich Regional Court ruled Friday that AI music generator Suno violated copyright by memorizing and reproducing six songs represented by GEMA, the German performing rights organization. The July 31 verdict marks the first EU court decision directly ruling on generative AI music training — and it went against the AI company.
What GEMA Proved #
GEMA presented evidence that Suno's model could produce audio misleadingly similar to specific protected compositions: Alphaville's "Forever Young," Lou Bega's "Mambo No. 5," and Boney M.'s "Daddy Cool" among them. The court heard testimony in March demonstrating matches in melody, harmony, and rhythm between Suno outputs and the original compositions.
The court found Suno was not entitled to use music represented by GEMA without a license or payment to rightsholders. Suno must now disclose revenue it earned and pay damages — amounts not yet set.
The Broader Context #
GEMA represents roughly 95,000 members in Germany and more than two million rightsholders worldwide. The society's previous AI win came in November 2025 when the same 42nd Civil Chamber ruled largely in its favor against OpenAI over ChatGPT's use of German song lyrics.
But lyrics were the warmup. Music tracks — the actual audio — are GEMA's core business. CEO Tobias Holzmüller called Friday's verdict "a decision of global significance."
Suno's Defense #
Suno says it disagrees with the ruling and is evaluating appeal options. The company's statement argues the decision rests on "a fundamental mischaracterization of how Suno's technology works, how it is used, and how US law applies." The core defense: Suno trains models to create new songs, not reproduce existing ones.
The court wasn't persuaded.
What Happens Next #
This is a first-instance ruling. Appeal is almost certain. But the precedent matters. If the Munich court's reasoning holds — that memorization and reproduction, even unintentional, constitutes infringement — then every AI music company training on copyrighted audio faces legal exposure in the EU.
Suno also faces RIAA litigation in the US from Universal, Sony, and Warner. Warner settled its case with Suno in November 2025, striking a first-of-its-kind licensing deal. The GEMA verdict may push other labels to hold out for better terms rather than settling.
The EU AI Act doesn't explicitly address music training data. This court ruling effectively fills the gap until legislators act.
