The model that rattled Silicon Valley last week now has Washington’s attention. A senior White House official has accused China’s Moonshot AI of breaking US export controls to build Kimi K3. It reached restricted Nvidia chips, he said, and leaned on American models to do it.
Kratsios directs the White House Office of Science and Technology Policy. He made the claim in a post on X, Bloomberg reported. Moonshot “acquired GB300-equipped servers and has accessed GB300s in Thailand, likely to train its AI models,” he said. That breached both US export rules and the labs’ terms of service. The GB300 is part of Nvidia’s Blackwell line, which the US bars from sale to Chinese firms.
The accusation follows months of official unease. Trump officials have been examining whether firms used a loophole to ship advanced chips to Chinese subsidiaries abroad. A May memo reaffirmed the ban on selling Blackwells to Chinese companies.
The post went further on the software side. Moonshot distilled Anthropic’s Fable model to build K3, Kratsios said. It ran a “sophisticated internal platform” for “large scale distillation against US models,” switching access methods to avoid detection. Distillation trains a cheaper model on a rival’s outputs. Kratsios drew a line: legitimate distillation is fair, covert theft of US technology is not. Nvidia and Moonshot did not respond to requests for comment.
Why Kimi K3 matters #
Kimi K3 is the reason any of this landed. The open-weight model, released last week, quickly climbed the leaderboards. Moonshot says it trails only Anthropic’s Claude Fable 5 and OpenAI’s GPT-5.6 on overall capability. Its arrival set off a rout in tech stocks, echoing DeepSeek a year earlier, and a wave of US alarm.
A fight already running hot #
Kratsios was not alone. Treasury Secretary Scott Bessent told Fox Business that Washington could sanction Chinese labs for intellectual-property theft. The complaints echo long-running claims from OpenAI and Anthropic, which has accused Moonshot of distilling its models before.
“This administration supports open source models, but what we do not support is IP theft,” Bessent said, as Bloomberg reported. He later warned, in a post on X, that sanctions and entity-list designations “will be on the table.”
Nvidia’s dissent #
As the worry spread, Nvidia chief executive Jensen Huang took the other side. He called open models like Kimi “excellent” and urged the US to embrace them, not ban them, Fortune reported. His case: shutting China out only pushes it to build its own stack. Z.AI has already done so, with a data centre running only Chinese chips.
The stakes #
The timing bites. Moonshot is racing to close a funding round at up to $50bn. A Hong Kong listing could follow this year. Targeted US sanctions would not ban the model. Anyone can already download it. But they could keep American money away.
Kratsios published no evidence for his claims. The model itself is not in doubt. What has shifted is the argument: no longer whether China can compete, but how it got there.
