You may not like that if you're in Washington. You still have to deal with it as it is. The market noticed too. The Associated Press reported on July 20 that Moonshot temporarily halted new Kimi K3 subscriptions after demand overwhelmed its capacity. That is the unglamorous detail that makes the story real. A model can win a benchmark and still run into GPU limits two days later. Chinese labs aren't magic. They are just moving fast enough to create facts before U.S. policy has settled on a response. A Ban Has Nowhere Clean To Land The cleanest tools Washington has are aimed at companies, not files. Procurement rules can stop federal agencies from buying services built on Kimi K3. Entity List designations can make it harder for Moonshot or other Chinese labs to buy U.S. technology. Security warnings can make a chief technology officer think twice before telling a board that production code or customer data is moving through a Chinese model. Those levers matter. They don't delete weights. That is the hole in the plan. If Moonshot follows through with a public weights release, any company that downloads the model can run it on its own infrastructure, tune it, wrap it, rename the internal service and keep going. Regulators can still punish obvious commercial relationships. They can make the compliance risk unpleasant. But open-weight software doesn't give them the same chokepoint as a hosted API. Axios reported that AI labs or their allies have floated open-source restrictions to the administration repeatedly over the past year. The idea keeps returning because the competitive pressure is real. It keeps stalling because the remedy punishes the wrong people first. Restricting American developers doesn't make Moonshot slower.
