The measure stems from Article 50 2 of the AI Act and the associated Code of Practice on Transparency of AI-Generated Content. Providers of generative AI systems must ensure that outputs of synthetic content audio, image, video or text are marked in a machine-readable format and detectable as artificially generated or manipulated, where technically feasible. Breaches can attract fines of up to €15 million or 3 per cent of worldwide annual turnover, whichever is higher. The Code, which Anthropic has signed alongside firms including Google, Meta, Microsoft, Mistral and OpenAI, provides practical guidance on meeting these legal requirements, which became applicable on August 2. Systems already on the market have until December 2, 2026 to comply, and providers must have an interoperable detection solution in place by February 2, 2027. According to Anthropic, the text watermark is woven directly into the generated content at the model level. It is described as imperceptible to human readers and is said not to alter the meaning, quality or readability of responses. Because it forms part of the text itself, the mark travels with copy-and-paste operations and “may persist through some editing”. Supported file types such as PNG, JPG and SVG receive digitally signed provenance metadata conforming to the Coalition for Content Provenance and Authenticity C2PA open standard. The marking applies across Claude products, including the API, Claude.ai, Claude Code, Claude Cowork and Claude Tag, and through cloud partners such as AWS, Google Cloud and Microsoft Foundry. Anthropic has chosen to implement it worldwide, wherever the supported models are offered, rather than limiting it to the European Economic Area. Anthropic acknowledges limitations. Detection tools and further technical details are to be published in forthcoming documentation. The company says a detected mark shows only that Claude may have processed the content, not that Claude wrote it. It adds that the absence of a mark does not establish that no AI was involved. The global scope has drawn criticism from technology policy experts and practitioners, who argue that the approach introduces practical and conceptual problems. Neil Chilson, head of AI policy at the Abundance Institute and a former chief technologist at the US Federal Trade Commission, described the outcome as an instance of the “Brussels Effect” applied one token at a time. This “Brussels Effect” is the tendency of EU rules to become de facto global standards because firms find it simpler to apply one strict regime worldwide than to maintain fragmented systems. Critics argue that it allows European regulators to shape products and speech for users who never voted for those rules. Chilson noted that Article 50 has prompted a leading American company to alter every text response from covered models worldwide. Because the watermark relies on statistical signals in word choices, he argued, the model must optimise simultaneously for user utility and a regulator-facing pattern. This necessarily constrains the output relative to an unmarked version and therefore reduces quality, even if the difference is rarely noticed by users. Chilson further observed that the mark is both over-inclusive, flagging lightly assisted human work, and easily evaded, rendering it of limited value for determining authorship, academic integrity or credibility. He called for EU policymakers to narrow the treatment of ordinary text and for Anthropic to restrict the mark to jurisdictions where the law requires it, or to offer users a choice. Techniques such as altered word choice, punctuation patterns or hidden characters, he wrote, either fail to survive ordinary editing or force the model into statistically less natural output. The result, in his view, is worse AI writing imposed for a purpose that cannot be achieved robustly. Similar concerns have been raised by others. Lyudmyla Kozlovska, president of the Open Dialogue Foundation, highlighted risks for civil society organisations that use AI to reduce the cost of translation, grammar correction or de-identification of sensitive material. Once detection tools become widely available, she warned, the mere presence of a Claude mark could be weaponised to discredit legitimate reports as “fabricated content”, even when human authors retain substantial control. Users and developers have also pointed to the emergence of tools purporting to strip the statistical signal while preserving meaning, and to the practical reality that routine workflows, such as rewriting, code reformatting or multi-model pipelines, will often erase or dilute the mark. Other major providers have likewise signed the Code, suggesting broader industry movement towards machine-readable marking. Research on earlier text-watermarking schemes, though, has repeatedly shown that paraphrasing or targeted attacks can reduce detection rates in a high proportion of cases, raising questions about long-term robustness. Tech entrepreneur Daniel Tenner noted that metadata stripping tools already exist, and predicted that a “cleanClaude” tool would be available within days of the public detector going online.
