Rule 26 Initial Disclosures: Checklist and AI Example Legal AI software vendor GC AI published a checklist and worked example for preparing Rule 26(a)(1) initial disclosures in federal civil cases, covering the four required categories — individuals with discoverable information, documents and ESI, damages computations, and insurance agreements — and the default deadline of 14 days after the Rule 26(f) conference, or 30 days after service or joinder for parties added later. GC AI says more than 2,100 legal teams use its product, including teams at TIME, Lockheed Martin, and Columbia Sportswear, and the example shows counsel using the tool to draft candidate entries, trace them to source passages, and flag gaps for review. Rule 26 Initial Disclosures: Checklist and AI Example By Caitlin Price, Social Media & Content Marketer•Published Rule 26 initial disclosures are the early exchange of information required in many federal civil cases without waiting for a discovery request. Under Rule 26 a 1 , they generally cover witness information, supporting materials, damages computations, and insurance agreements. The rule’s qualifications, exemptions, stipulations, and court orders determine what a particular case requires. For in-house litigation counsel, preparation starts with the complaint, answer, business records, and information from the people who maintain them. AI can help organize proposed entries and connect them to source passages. Keep allegations, admissions, conflicting evidence, and gaps distinct so counsel can see what supports each entry and what still needs investigation. GC AI is legal AI software built for in-house counsel, with capabilities for legal research, drafting, and document analysis. More than 2,100 legal teams use GC AI, including teams at TIME, Lockheed Martin, and Columbia Sportswear. The example dispute below shows how to use GC AI to prepare candidate entries, inspect their sources, and assemble a packet for counsel’s review. What Are Rule 26 Initial Disclosures? Federal Rule of Civil Procedure 26 a 1 generally requires four categories of initial disclosures without awaiting a discovery request. The rule includes exemptions, and a stipulation or court order can change the requirements. Responsible counsel should establish the applicable scope before the team starts drafting. Category What Counsel Must Address Individuals Each individual likely to have discoverable information that the party may use to support its claims or defenses, with the subjects of that information and the person’s address and telephone number if known. The rule excludes use solely for impeachment. Documents, Electronically Stored Information, and Tangible Things Copies, or descriptions by category and location, of material in the party’s possession, custody, or control that it may use to support its claims or defenses, subject to the same impeachment exception. Damages A computation of each category of damages the party claims, with supporting documents or other evidentiary material available for inspection and copying as under Rule 34, unless privileged or protected. Insurance Insurance agreements under which an insurance business may satisfy all or part of a possible judgment, or indemnify or reimburse payments made to satisfy it, available for inspection and copying as under Rule 34. When Are Rule 26 Initial Disclosures Due? Under Rule 26 a 1 C – D , the default deadline is at or within 14 days after the Rule 26 f conference. Counsel must check for a different stipulated or court-ordered deadline and the rule’s conference-objection procedure. A party first served or joined after the conference generally has 30 days after service or joinder, subject to stipulation or order. A list of names and documents addresses only part of this work. Build the packet so damages and insurance receive their own review, including when the supplied materials provide no answer. How to Prepare Rule 26 Initial Disclosures With AI Use the workflow to give counsel a traceable set of candidates and unresolved questions: Establish the source set and counsel’s instructions. Map the claims and defenses to supporting and conflicting material. Identify potential witnesses, document categories, and locations. Develop the damages and insurance entries and record gaps. Verify the packet and hand it to responsible counsel. Establish the Source Set Upload approved working copies through GC AI’s Files, a reusable document library where you can save and organize material for use in GC AI chats. Attach the selected files to a chat so GC AI can retrieve relevant passages and cite the content it uses. Maintain a source inventory with a stable file ID, document date, version, custodian, original business-system location, and known missing attachments. Record the original location separately from the copy uploaded for analysis. In this synthetic example, Alder Devices, a defendant and counterclaimant, is preparing its internal packet after Northstar Components sues for payment. All company names, people, excerpts, amounts, locations, and outputs in this example are synthetic. The tables illustrate a proposed work product; they do not report a GC AI test or an actual case. File ID and Source Synthetic Excerpt F01, Complaint, Paragraphs 8–10 “Northstar delivered 100 units required by Purchase Order 104 on May 1, 2026. Alder has not paid the $100,000 invoice.” F02, Answer and Counterclaim, Paragraphs 8–10 and 22 “Alder admits entering Purchase Order 104 but denies complete delivery. Alder received 60 units and purchased 40 replacement units. Alder seeks $18,000 in additional purchase costs and $6,000 in expedited freight.” F03, Signed Purchase Order 104, Page 2 “Quantity: 100 units. Unit price: $1,000. Delivery date: May 1, 2026.” F04, May 2 Email Thread, Messages 1–2 Alder warehouse manager Mara Chen: “I counted 60 units at receiving yesterday.” Northstar sales manager Evan Price: “Our shipping record shows 100 units departed.” “Prepared by Dana Ruiz, Alder Finance. Replacement purchase: 40 × $1,450 = $58,000. Original price for 40 units: $40,000. Additional freight: $6,000. Freight receipt pending.” F06, Risk Manager’s May 8 Email “Jo Park, Alder Risk: I requested potentially applicable policies and endorsements from our broker. I have not received them.” For this synthetic example, treat the original systems and custodians in the document-location table below as supplied source-inventory information. The excerpts alone do not establish those locations. In a real matter, confirm them with the people who maintain the records. Keep counsel’s instructions separate from the evidence. Counsel should supply the represented party, operative pleadings, confirmed deadline, applicable orders, and questions requiring legal research. The company should identify who owns collection and follow-up. A first prompt can establish the extraction rules: Work from F01–F06 and the supplied source inventory to prepare Alder’s internal initial-disclosure packet. Separate allegations, admissions, denials, business-record statements, and unresolved conflicts. Cite the file ID and precise locator for every factual entry, and state “not found in supplied materials” when information is absent. Do not infer that a missing record does not exist. Leave disclosure selection, privilege, and legal conclusions for counsel. Preparation also depends on appropriate litigation preservation. An upload inventory records what the analysis includes; it does not establish that the company has preserved or collected everything reasonably available. Build the Claims-and-Evidence Matrix Ask GC AI to connect each pleaded issue to the supplied material and preserve contradictions. For each issue, identify the record counsel needs to inspect and the decision counsel must make. Illustrative output: Issue Source-Supported Entry Conflict or Gap Counsel’s Decision Northstar’s payment claim F01 ¶¶8–10 alleges complete delivery and a $100,000 unpaid invoice. F02 ¶¶8–10 admits the purchase order and denies complete delivery. The invoice and payment ledger are absent from the supplied set. Confirm Alder’s position and identify records it may use to support its defenses. Delivered quantity F03 p.2 requires 100 units. F04 contains Mara’s report of 60 received and Evan’s report of 100 shipped. Shipping and receipt describe different events. Neither underlying record appears in the set. Supporting replacement-purchase documents and the freight receipt are absent. Verify the amounts, claimed categories, and supporting material. The matrix should preserve the difference between “Northstar alleges delivery” and “Northstar delivered.” Likewise, an email reporting a shipment does not establish receipt. Our Exact Quote feature lets you click a citation to open the source and inspect the highlighted passage. Use it to check whether each proposed matrix entry matches the record. Review the surrounding text, author, date, and attachments as well as the quoted words. File citations also provide passage previews and source navigation. For the delivery row, counsel should inspect both messages. A citation to Mara’s count alone would leave out a material conflict. Map Potential Witnesses and Document Locations Run the next pass from the same source set: Create a potential-witness map showing name, stated role, subjects of knowledge, source, and known address and telephone number. Mark missing contact information explicitly. Then list candidate document categories and their supplied original locations. Distinguish a person mentioned in a file from a person counsel selects for disclosure. Illustrative witness/source map: Person Potential Subject and Source Follow-Up Mara Chen, Alder Warehouse Manager Receipt and count of the shipment, F04 message 1 Confirm personal knowledge, related receiving records, and contact details. Evan Price, Northstar Sales Manager Reported shipment quantity, F04 message 2 Confirm the basis of his statement and contact details. Dana Ruiz, Alder Finance Replacement-cost computation, F05 header and rows 2–4 Verify preparation method, supporting records, and contact details. Jo Park, Alder Risk Status of policy collection, F06 Identify potentially applicable agreements and the people maintaining them. The synthetic source set contains no addresses or telephone numbers, so the working map should mark those fields as missing. Counsel selects the individuals who meet the rule’s standard and confirms their subjects of knowledge, adding addresses and telephone numbers if known. For documents, keep the proposed category, original location, and collection status visible together. Illustrative document-category and location map: Candidate Category Supplied Original Location or Custodian Current Packet Purchase order and related amendments Alder legal document system, “Northstar / PO 104” F03 includes the signed purchase order; confirm whether amendments exist. Delivery correspondence and receiving records Mara’s company mailbox and warehouse receiving system F04 includes correspondence; receiving record missing. Replacement-purchase and freight records Dana’s finance folder, “PO 104 Replacement” F05 includes the worksheet; supporting records missing. Invoice and payment records Alder accounts-payable system Referenced by F01; no copy supplied. Potentially applicable insurance agreements Jo’s risk-management repository and broker F06 records the request; agreements missing. Counsel must assess possession, custody, or control and which material Alder may use. A working category table does not resolve those questions. It also does not turn a link to an uploaded copy into an adequate description of the original material’s location. Address Damages and Insurance Explicitly Alder’s counterclaim makes the damages category concrete. Ask GC AI to reproduce each computation, identify its inputs, and flag unsupported amounts: For each category Alder claims, show the formula, amount, source locator, and supporting material supplied or missing. Keep arithmetic separate from the legal assessment of recoverable damages. Do not add a damages category or amount that the sources do not provide. Illustrative damages entry: Additional purchase cost: 40 × $1,450 − $1,000 = $18,000, using F03 p.2 and F05 rows 2–3. Expedited freight:$6,000, reported in F05 row 4; the receipt remains outstanding. Total asserted in these categories:$24,000, consistent with F02 ¶22. Finance must verify the transactions and supporting records. Counsel determines the legally appropriate computation and disclosures. Matching the pleading’s total does not establish that the inputs are correct or that the claimed loss is recoverable. For insurance, the appropriate entry is “Agreements not supplied; inquiry remains open.” F06 supports that statement. It does not establish that no insurance agreement could satisfy Rule 26 a 1 A iv . Consolidate the outstanding work in a gap log. Assign the missing invoice and payment ledger to accounts payable, coordinating with in-house legal, so counsel can assess Alder’s position and supporting records. Track the remaining follow-up as follows: Gap Follow-Up Owner Required Next Action Conflicting shipment and receipt accounts In-house legal, coordinating with operations Obtain the receiving record and request the underlying shipping record through the appropriate channel. Missing damages support Finance Provide replacement-purchase records and the freight receipt; reconcile the worksheet. Missing insurance agreements Risk management Obtain potentially applicable policies and endorsements for counsel’s assessment. Missing witness contact information In-house legal Confirm known addresses and telephone numbers and provide them to litigation counsel. An internal gap log organizes the inquiry. The party must still disclose based on the information then reasonably available and meet the applicable deadline, even if its investigation is incomplete. Verify the Packet and Record Counsel’s Decisions Our Research feature searches legal and web sources and returns answers with citations. It can combine that research with uploaded files, allowing you to investigate a defined legal question alongside the case materials. Keep extracted facts separate from legal analysis, and have counsel open the cited authorities to verify their currency, applicability, and support for the answer. For example: Research the initial-disclosure requirements applicable to this matter using the identified federal district, current rules, and supplied court orders. Identify any source that changes the default timing or scope. Cite the governing provisions and distinguish them from explanatory commentary. Flag missing local rules or orders rather than assuming the federal default controls. Responsible counsel should complete a review checklist before converting the packet into disclosures: Applicable requirements: Confirm the governing rules, exemptions, orders, stipulated changes, and deadline. Source accuracy: Open cited passages, check context, reconcile conflicts, and correct unsupported entries. Reasonable inquiry: Confirm which people and systems the team consulted and investigate material gaps beyond the uploaded set. Disclosure decisions: Select individuals and material under the applicable standard, verify damages computations, and assess insurance agreements. Privilege and protection: Decide what warrants withholding and how to assert the basis without revealing protected information. Final ownership: Identify the attorney of record responsible for signature, the person arranging service, and the owner of later updates. Privilege review requires more than a “privileged” label from AI. When a party withholds otherwise-discoverable information on a claim of privilege or trial-preparation protection, Rule 26 b 5 A requires an express claim and a sufficient description to allow assessment without revealing the protected information. The current Rule 26 f 3 D also addresses the timing and method for complying with that requirement in the discovery plan. Under Rule 26 g , the attorney of record’s signature certifies, after reasonable inquiry, that a disclosure is complete and correct when made. In-house preparation supports that inquiry; the responsible signatory makes the certification. Manually assemble the reviewed matrix, witness map, document categories, damages and insurance entries, gap log, and checklist in the team’s approved matter workspace. Preserve the source IDs, version date, reviewer, decisions, and outstanding owners. Check every reference after copying the work into the handoff document. For a first evaluation, use an approved or synthetic source set with a known conflict and a missing attachment. Inspect whether the packet preserves both, whether every proposed entry traces to its source, and whether counsel can identify the next action. Can AI Prepare Rule 26 Initial Disclosures From the Complaint Alone? A complaint provides allegations, but it does not establish all the information needed for initial disclosures. Use the operative answer and any counterclaims, relevant business records, and information from the people who maintain them. AI can organize proposed entries and source references; counsel must assess disclosure scope, missing information, privilege, and the reasonable inquiry supporting the signed disclosure under Rule 26 g . What Happens If Rule 26 Initial Disclosures Are Incomplete? Counsel should assess the missing information, the applicable deadline, and whether correction or supplementation is required. Under Rule 37 c 1 , a party that fails to disclose information or a witness as required by Rule 26 a or e generally cannot use it on a motion, at a hearing, or at trial unless the failure was substantially justified or harmless. On motion and after an opportunity to be heard, the court may impose additional remedies. Can You Wait Until the Other Party Makes Its Initial Disclosures? No. Rule 26 a 1 E requires disclosures based on the information then reasonably available. An incomplete investigation, a challenge to another party’s disclosures, or that party’s failure to disclose does not excuse your own obligation. Counsel should address any timing issue under the applicable rules and orders. Do You File Initial Disclosures With the Court? Generally, you serve initial disclosures on the other parties. Rule 26 a 4 requires written, signed, and served disclosures unless the court orders otherwise. Rule 5 d 1 A says initial disclosures must not be filed until used in the proceeding or the court orders filing. Check applicable local rules and orders for related filing requirements. Can You Use This Packet for a State Court Case? You can adapt the organizational method, but counsel must research the applicable state rules and court orders. The federal Rule 26 categories, exemptions, and deadlines do not automatically govern a state court case. Confirm the required disclosures before adapting the prompts or tables. How Should You Update the Packet When More Files Arrive? Add the approved files in GC AI and ask for proposed changes tied to the existing source IDs and packet entries. Counsel should verify the changes and assess whether supplementation is required. Rule 26 e 1 requires timely correction or supplementation when disclosures are materially incomplete or incorrect and the information has not otherwise become known to the other parties during discovery or in writing, or when the court orders it. Record the approved revision and any service separately.
