Oracle has ended its legal challenge to Wisconsin utility rules that could require the company to provide more than $100 million a year in financial guarantees tied to electricity infrastructure for a massive AI data center project.
The withdrawal leaves Wisconsin regulators’ requirements in place and highlights a growing challenge of the AI boom: supplying enough electricity for hyperscale facilities, while deciding who pays for the power infrastructure if a project fails or changes course.
Oracle is working with OpenAI and Vantage Data Centers on Lighthouse, a $15 billion data center campus in Port Washington, Wisconsin. The roughly 670-acre development is scheduled for completion in 2028. Its first phase alone is expected to require about 1.3 gigawatts of generation capacity.
Providing power at that scale typically requires utilities to spend hundreds of millions of dollars on generation facilities and other infrastructure before a data center begins full operation. This creates financial risk for utility customers if a developer cancels a project or does not remain in business long enough for the utility to recover its investment.
Wisconsin regulators have moved to put more of that risk on data center operators. The Public Service Commission of Wisconsin approved a rate structure for utility company We Energies customers that have exceptionally large electricity requirements. Under the rules, a company needs a Standard & Poor’s credit rating of at least A-, or a Moody’s rating of A3, to avoid requirements for additional financial backing. Customers with lower ratings must put up collateral.
That credit rating requirement is problematic for Oracle: The company had a BBB rating when it challenged the rules, below the Wisconsin threshold. S&P Global Ratings cut Oracle’s rating another step to BBB- on July 9, leaving the company at the bottom of the investment-grade scale. Oracle has taken on debt as it spends heavily on AI and data center capacity, including infrastructure associated with OpenAI.
For Oracle, the Wisconsin requirements could translate into annual costs above $100 million for financial security. The company argued that the rules were too costly and could make Wisconsin less attractive for tech investment. After state regulators declined to revisit the provisions, Oracle went to court. That fight has now ended, as Oracle’s attorneys voluntarily dismissed the case on August 17. The company said it remains committed to covering the electricity costs associated with its operations and working with Wisconsin officials.
The issue of who is responsible for AI buildout costs is taking on greater urgency, especially as data center electricity loads become comparable to a sizable population center. Wisconsin’s approach places part of that responsibility on the data center operator and links the requirement to its creditworthiness.
