# OpenAI Settles DOJ Worker Discrimination Allegations

OpenAI OpCo and subsidiary Statsig agreed on August 4 to a $3.2 million Justice Department settlement over allegations that their PERM recruitment favored temporary visa holders and discouraged U.S. applicants. The resolution includes $1.2 million in civil penalties and a $2 million compensation fund; OpenAI told the Daily Caller that it disagreed with the findings but settled to continue its PERM program.

OpenAI OpCo LLC and its subsidiary Statsig Inc. agreed on August 4 to a combined **$3.2 million** settlement with the Justice Department's Civil Rights Division. The resolution addresses allegations that the companies violated the Immigration and Nationality Act by discriminating against U.S. workers and preferring temporary visa holders during recruitment through the Permanent Labor Certification, or PERM, process.

The Justice Department says **$1.2 million** will be paid as civil penalties and **$2 million** will fund compensation for eligible workers. Bloomberg Law independently reported the same allocation. The department said fewer than 10 PERM positions were at issue.

OpenAI disputes the findings. In a statement reported by the Daily Caller, the company said it reached the agreement to resolve the matter and continue its PERM program, which it described as important for employees and candidates who need immigration support.

### The alleged recruitment practices

The Justice Department says OpenAI did not advertise the relevant PERM positions on its external jobs website even though it regularly listed other openings there. It also says applicants for the PERM roles were required to mail paper applications while electronic applications were accepted for other positions.

The department further alleged that the companies used recruitment practices that discouraged U.S. applicants, including late-night radio advertisements. The settlement requires OpenAI to post PERM positions on its public careers site, accept electronic applications, train personnel on the INA's anti-discrimination rules, revise employment policies, and submit to departmental monitoring and reporting.

PERM is the labor-certification process employers generally use when sponsoring workers for employment-based permanent residency. Employers must test the U.S. labor market and document good-faith recruitment before obtaining certification. The settlement resolves allegations; it is not a court judgment that independently adjudicated the disputed facts.

### Why the case matters to technical employers

The case concerns employment compliance rather than OpenAI's models or products, but it is relevant to AI companies competing for specialized engineering and research talent. Different visibility, application channels or recordkeeping for immigration-sponsored roles can create legal exposure even when only a small number of positions is involved.

For comparable employers, the operational lesson is to align job posting, application intake, retention and audit procedures across PERM and ordinary requisitions while preserving documented, lawful sponsorship support. The settlement's monitoring and policy requirements make those workflow controls more than an administrative detail.

## Key Points

- 1OpenAI and Statsig agreed to a $3.2 million DOJ settlement over alleged discriminatory PERM recruitment practices affecting U.S. workers.
- 2The resolution includes $1.2 million in civil penalties and a $2 million compensation fund, with fewer than 10 positions at issue according to DOJ.
- 3The settlement requires public posting, electronic applications, training, policy changes and monitoring for PERM recruitment.

## Scoring Rationale

The settlement is a concrete employment-compliance action involving a leading AI company, a multimillion-dollar resolution and mandated recruitment controls, although it does not affect model capabilities or product availability.
