The bill would halt all new AI data center builds until federal safeguards on energy, environment, and privacy are in place, with ripple effects for crypto mining
Rep. Alexandria Ocasio-Cortez and Sen. Bernie Sanders have introduced legislation that would slam the brakes on new AI data center construction across the US. The Artificial Intelligence Data Center Moratorium Act would impose an immediate federal on building or expanding AI data centers until Congress passes comprehensive national safeguards.
What the bill actually does #
Sanders introduced the Senate version, designated S.4214, on March 25, 2026. The House counterpart from Ocasio-Cortez followed on June 24, 2026.
The moratorium would remain in effect until Congress enacts what the bill describes as “strong national safeguards.” Those safeguards would need to address a laundry list of concerns: energy costs for consumers, environmental harm, job displacement, privacy rights, and civil rights.
The Senate bill was referred to the Commerce, Science, and Transportation Committee. Its odds of passing in the current political climate are, to put it diplomatically, not great.
At least a dozen states are already pursuing or considering their own moratoriums on AI data centers, suggesting the federal bill is riding a wave rather than creating one.
The energy overlap with crypto #
The legislation itself doesn’t explicitly mention cryptocurrency or Bitcoin mining. But the energy conversation it forces is impossible to separate from the crypto mining debate.
The bill references warnings from Elon Musk about the risks of unchecked AI growth.
What this means for investors #
The bill’s focus on environmental harm and consumer energy costs mirrors arguments that have been leveled at Bitcoin mining for years. If even a fraction of the dozen-plus states considering data center moratoriums follow through, Bitcoin miners could face a patchwork of state-level restrictions that complicate site selection and increase operational costs.
