# Netlist Asks US Customs to Block Micron's AI Memory Chips at the Border

Netlist announced on August 12 that it had gone to the US International Trade Commission against Micron, Supermicro, HPE and Lenovo, asking for exclusion and cease-and-desist orders tied to four patents covering DDR5 RDIMM and MRDIMM memory. You don't need to follow every patent docket to see the point. These are the memory modules that sit inside the servers feeding the AI buildout, and Netlist is asking for a remedy that can stop allegedly infringing products from entering the United States.

That is the sharp edge here. A normal patent suit can end in damages, licensing fees, appeals and years of lawyerly delay. An ITC exclusion order is different because US Customs and Border Protection enforces it at the border. Netlist's own release says Micron manufactures the accused memory products overseas, which is why the company is pushing the fight through a trade venue rather than only through district court.

Netlist's complaint names US Patent Nos. 10,025,731, 10,217,523, 12,373,366 and 12,675,407. The company also filed a parallel case against Micron in the US District Court for the Central District of California, where the docket shows the case was filed on August 10. The ITC notice published in the Federal Register says the complaint was received on August 11, and Netlist announced it publicly the next morning.

According to Netlist, the two proceedings overlap but aren't identical: the district court case asserts two of the same patents, while the ITC complaint seeks import relief across DDR5 RDIMMs and MRDIMMs. ITC cases usually move faster than federal patent cases, and Netlist said they commonly reach trial within a year. That speed is part of the pressure tactic. Micron can fight, but it can't treat the venue as background noise.

## The memory market has no cushion

Micron is not limping into this dispute. Its fiscal third-quarter results, reported on June 24, showed revenue of $41.46 billion, up from $9.30 billion in the same quarter a year earlier. CEO Sanjay Mehrotra called out the strategic value of memory in the AI era, and the numbers back that up. HBM and enterprise DRAM have turned memory from a cyclical afterthought into one of the hardest-to-source parts of the AI stack.

Still, strong demand doesn't make an import fight harmless. Barron's reported this week that Micron shares were around $912 and had lost more than 3% over five trading days, even after a near-700% surge that left investors questioning how much good news was already priced in. MarketWatch also noted that Micron fell with other memory names during a broader chip selloff on August 24.

Then there is the shortage itself. Tom's Hardware's RAM price tracker, last updated August 24, showed a 32GB DDR5-6000 kit at about $402, compared with lowest-ever tracked prices near $72 for similar capacity and speed. The pressure comes from AI buyers taking more of the memory industry's output. Samsung, SK Hynix and Micron have every reason to steer wafers and packaging toward HBM and server DRAM, because Nvidia systems and hyperscale data centers pay for that capacity. Consumer RAM gets what is left. Data center buyers don't love that squeeze either, because they are buying at far larger scale.

Now add trade policy. Reuters reported on August 27, citing Politico, that the Trump administration is weighing another round of semiconductor tariffs that could reach laptops, gaming consoles and data center servers. Commerce Secretary Howard Lutnick reportedly favors tying tariff relief to US chip manufacturing investment. The White House's January proclamation already imposed a 25% tariff on certain advanced computing chips while carving out uses including US data centers, startups and research. If those exemptions change, memory buyers get another cost risk at the same time Netlist is asking the ITC to consider an import block.

## Netlist is small, but the venue is not

Frankly, that is why this fight is worth watching. Netlist is not Micron. It is an Irvine, California company built around memory products and patent licensing, and its scale is tiny next to a global DRAM maker. But Section 337 cases are not popularity contests. If the ITC finds a violation and decides an exclusion order is warranted, company size won't save the respondent from border enforcement.

Netlist also comes into the Micron fight with fresh leverage. On August 5, it announced a five-year strategic alliance with Samsung covering a patent cross license, alongside product supply and technology cooperation. Netlist's SEC filing says Samsung will pay a $239 million upfront license fee, about $200 million net of Korean withholding taxes, plus quarterly license fees that can run up to about $32.9 million before withholding and deductions. The same filing says Samsung will supply up to $1.5 billion of DRAM and NAND products over the five-year term.

SK Hynix is part of the longer story too. Netlist's 2021 SEC filing shows a five-year patent and supply agreement with SK Hynix that included a $40 million payment and access to up to $600 million of SK Hynix memory products. So when Netlist says Micron is the holdout, that claim has real history behind it.

The ITC has not yet instituted the new Micron investigation. The Federal Register notice is still at the complaint-and-public-interest-comment stage. If the commission opens the case, the next important facts will be the respondents named in the notice and the schedule. Watch too for whether any public-interest arguments emerge around AI servers and already-tight memory supply.

Micron can survive a patent fight. The harder question is whether its customers can shrug off another possible bottleneck when DDR5 and MRDIMM supply is already expensive and politically exposed - and tied directly to the pace of AI server deployment.
