The lawsuit alleges private nuisance, public nuisance and negligence, including inadequate soundproofing, acoustic barriers, low-noise cooling equipment and monitoring. The Bitcoin operation uses an exposed wall to move outside air through the building. Horne said company-hired sound engineers measured conditions while mining equipment was shut down and found background readings close to the city limits, suggesting other sources also contribute. Alliance Cloud Services signed an agreement in June to provide an unidentified neocloud customer with 20 megawatts of AI capacity. Hyperscale said it operated about 28 megawatts of Bitcoin-mining capacity at the campus as of June 24 and expected to spend $100 million to $120 million retrofitting approximately 60,000 square feet for the initial AI deployment.[[5]](https://www.sec.gov/Archives/edgar/data/896493/000121465926007704/x6242618k.htm)\n\nThe 20-megawatt commitment is more concrete than Hyperscale’s longer-term expansion target. The company says the campus may eventually support more than 300 megawatts, but it cautions that such growth depends on financing, regulatory approvals, engineering work, infrastructure and utility agreements.[[5]](https://www.sec.gov/Archives/edgar/data/896493/000121465926007704/x6242618k.htm)\n\nThe company has also acquired 48.5 adjacent acres, which Horne said would provide a buffer rather than additional development near the homes. It has offered to purchase properties from Louise Avenue residents. Residents said a company representative described the price as fair market value, and Horne later said Hyperscale would cover moving expenses.
