# Judge lets NAACP pollution suit against SpaceXAI continue, rejects DOJ dismissal bid

- The U.S. District Court for the Northern District of Mississippi allowed the EPA administrator to intervene in the NAACP’s case against X.AI Corp. and MZX Tech, but rejected the government’s request to dismiss the suit. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)
- The NAACP alleges that 27 gas-fired turbines at the Colossus Gas Plant in Southaven were built and operated without required Clean Air Act permits or best available control technology. [\[2\]](https://naacp.org/sites/default/files/documents/1%20-%20Complaint.pdf)
- The court said the government could preclude a citizen suit by diligently prosecuting its own enforcement action, but had not done so here. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)
- The ruling leaves the underlying pollution allegations, the NAACP’s preliminary-injunction request and the defendants’ motion to dismiss unresolved. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)

A federal judge has blocked the Trump administration from unilaterally ending a Clean Air Act lawsuit over SpaceXAI’s data-center power plant in Southaven, Mississippi, allowing the NAACP’s pollution claims to proceed. Judge Debra Brown of the U.S. District Court for the Northern District of Mississippi ruled on October 19 that the EPA administrator has a statutory right to intervene in a citizen suit, but that neither the Clean Air Act nor the Federal Rules of Civil Procedure gives the government authority to dismiss the plaintiffs’ case over their objection. ## The allegations against SpaceXAI

The NAACP and the Mississippi State Conference of the NAACP filed the complaint on April 14 against X.AI Corp. and MZX Tech LLC. The complaint identifies MZX Tech as the owner and operator of the Colossus Gas Plant at 2875 Stanton Road South and xAI as an operator involved in managing the facility. [\[2\]](https://naacp.org/sites/default/files/documents/1%20-%20Complaint.pdf)

The lawsuit concerns the plant’s power supply for the nearby Colossus 2 data center in Memphis, Tennessee. The complaint alleges that the companies installed 27 natural-gas combustion turbines between August and December 2025 and began operating them without a Clean Air Act construction permit, operating permit or certification of construction. It says the turbines had combined generating capacity of at least 495 megawatts and potential annual nitrogen-oxide emissions of more than 1,700 tons. Those are allegations in the complaint, not findings by the court. [\[2\]](https://naacp.org/sites/default/files/documents/1%20-%20Complaint.pdf)

The plaintiffs also allege violations involving prevention-of-significant-deterioration rules, best available control technology and hazardous-air-pollutant standards. They seek an injunction requiring the companies to stop operating the plant except in compliance with the law, install required pollution controls and pay civil penalties of up to $124,426 per day per violation. [\[2\]](https://naacp.org/sites/default/files/documents/1%20-%20Complaint.pdf) The complaint says schools, churches and nearby communities—including predominantly Black communities—could be affected by the emissions. Some later reporting has described a larger number of turbines associated with SpaceXAI’s Southaven operations. The 27-turbine figure in this article refers specifically to the plant and allegations detailed in the April complaint. ## Why the government’s dismissal argument failed

The Justice Department, acting on behalf of EPA Administrator Lee Zeldin, argued that the government could intervene as a plaintiff and then dismiss the NAACP’s case because federal enforcement decisions belong to the executive branch. The government also raised Article II concerns about allowing private plaintiffs to seek civil penalties payable to the Treasury. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)

Brown accepted that the Clean Air Act gives the EPA administrator an unconditional right to intervene. She rejected the broader claim that intervention carries an automatic power to terminate another plaintiff’s lawsuit. The statute identifies a specific circumstance in which government enforcement can block a citizen suit: EPA or a state must have started and be diligently prosecuting its own civil action seeking compliance. The United States did not argue that condition applied here. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)

The judge distinguished cases involving EPA enforcement actions, compliance orders or consent decrees that had already addressed alleged pollution. In this case, she wrote, the government had not brought an enforcement action against the defendants and had indicated that it did not intend to do so. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf) Brown concluded that Congress allowed private parties to sue when federal or state agencies decline to enforce the Clean Air Act. ## The permitting dispute is still unresolved

The October 19 order does not determine whether SpaceXAI or MZX Tech violated the Clean Air Act, whether the turbines qualify as stationary sources, or whether the companies’ permitting position is legally valid. The court decided only that the government could not end the case through the dismissal theory it presented. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)

The ruling also did not grant the NAACP’s requested injunction. The complaint asks the court to stop operation until the required permits and pollution controls are in place, but the court has not ruled on that request. The defendants’ motion to dismiss also remains pending. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)[\[2\]](https://naacp.org/sites/default/files/documents/1%20-%20Complaint.pdf)

The United States was allowed to intervene, but Brown ordered it to file a pleading explaining the claim or defense it intends to present. The order set October 23 as the filing deadline and October 30 for any required response. [\[4\]](https://trace.law/monitor/cases/national-association-for-the-advancement-of-colored-people-v-x-ai-corp-4e34970897c28c34) The government’s earlier appeal was premature because the judge’s statement during an August status conference that she intended to deny the motion was not a binding order. [\[1\]](https://cdn.arstechnica.net/wp-content/uploads/2026/10/NAACP-v-xAI-Opinion-10-19-26.pdf)

The practical effect of the ruling is narrower than a finding against SpaceXAI: the NAACP’s citizen-suit route remains open while the court considers the pollution, permitting and standing questions in the underlying case.
