What HateAid alleges
HateAid bases its complaint on Germany's Telecommunications, Digital Services and Data Protection Act, or TDDDG. The group argues that the law prohibits bringing to market communications devices disguised as everyday objects and designed to record images or private speech without the subject realizing it.
The organization's statement says a conviction under the provisions it cites could bring a fine or up to two years in prison, along with forfeiture of proceeds. Those are HateAid's legal claims about possible consequences, not a determination that any named company or executive violated the law. HateAid says it is seeking a precedent for how German law applies to smart glasses and expressly notes the presumption of innocence.
Meta points to its recording safeguards
Meta told Politico and Heise that the glasses were reviewed by Germany's Federal Network Agency, BNetzA, in 2022 and were built with privacy safeguards. The company points to a white capture LED that blinks during photo or video recording and technology intended to disable the camera when the light is covered or tampered with.
Heise reported that Mister Spex had not received an official notice or the complete complaint and could not yet assess the allegations. MediaMarktSaturn said its suppliers are contractually required to comply with applicable law and questioned why HateAid had targeted the retailer before resolving the issue with the manufacturer and BNetzA.
Anadolu Agency reported that BNetzA's broader position is that smart glasses can be prohibited when optical or acoustic signals do not sufficiently disclose recording, but that ownership, import and sale are not automatically prohibited when the function is clearly recognizable. Its report said the regulator was monitoring the market and had not opened a formal investigation.
Bystander notice is the policy question
The dispute is therefore not simply about whether the device has a light. It is about whether people nearby can recognize ordinary-looking eyewear as a camera and understand when recording is taking place. The filing itself is neither a formal investigation nor a court ruling.
For teams building multimodal wearables, the case illustrates that privacy controls may be evaluated at the physical-interface level as well as through software settings, retention policies and model safeguards. Recording indicators, tamper resistance and third-party notice can become part of the legal and product-design boundary.
