The court heard testimony in March demonstrating matches in melody, harmony, and rhythm between Suno outputs and the original compositions.

GEMA represents roughly 95,000 members in Germany and more than two million rightsholders worldwide. The company's statement argues the decision rests on "a fundamental mischaracterization of how Suno's technology works, how it is used, and how US law applies." The core defense: Suno trains models to create new songs, not reproduce existing ones.

The court wasn't persuaded.

## What Happens Next

This is a first-instance ruling. Appeal is almost certain. But the precedent matters. Suno also faces RIAA litigation in the US from Universal, Sony, and Warner. Warner settled its case with Suno in November 2025, striking a first-of-its-kind licensing deal. The GEMA verdict may push other labels to hold out for better terms rather than settling.

The EU AI Act doesn't explicitly address music training data. This court ruling effectively fills the gap until legislators act.
