ByteDance signs AI copyright MOU with Motion Picture Association in historic first deal

ByteDance signed a memorandum of understanding with the Motion Picture Association on August 17, marking the first formal copyright agreement between Hollywood's trade group and an AI company. The deal covers ByteDance's generative AI tools Seedance and Seedream, as well as TikTok, CapCut, and Dreamina, committing to guardrails against copyright infringement. MPA Chairman and CEO Charles Rivkin and ByteDance General Counsel John Rogovin led the agreement, which follows a cease-and-desist letter sent on February 20, 2026, over Seedance 2.0.

The memorandum of understanding covers TikTok, CapCut, and ByteDance's generative AI tools after Hollywood's trade group raised alarms over unauthorized use of copyrighted material.

ByteDance has signed a memorandum of understanding with the Motion Picture Association, marking the first time Hollywood’s most powerful trade group has struck a formal copyright agreement with an AI company. The deal, announced on August 17, commits ByteDance to implementing guardrails across its generative AI tools and user-generated content platforms to protect copyrighted material.

The agreement covers ByteDance’s AI video generator Seedance, its image tool Seedream, and content platforms TikTok, CapCut, and Dreamina.

From cease-and-desist to collaboration #

The MPA’s concerns about ByteDance’s AI tools began escalating in February 2026, shortly after the launch of Seedance 2.0. The updated video generation tool drew immediate criticism from the trade group for enabling what it characterized as large-scale copyright infringement.

On February 20, 2026, the MPA sent ByteDance a cease-and-desist letter demanding the company build stronger protections against unauthorized use of copyrighted content. The letter specifically targeted the ease with which users could generate content featuring recognizable characters, scenes, and actor likenesses owned by MPA member studios.

ByteDance responded by rolling out updated versions of its tools with additional safeguards and signaled its willingness to work with the MPA on longer-term solutions. That willingness eventually materialized into the MOU announced this week.

MPA Chairman and CEO Charles Rivkin and ByteDance General Counsel John Rogovin were the key figures behind the agreement. Both sides framed the deal as a model for how AI developers and content creators can coexist without one side treating the other’s work as free training data.

What the deal actually requires #

The MOU commits ByteDance to implementing what both parties described as “meaningful guardrails” against copyright infringement across its AI products and platforms. The specific technical mechanisms were not disclosed.

The MPA represents some of the largest entertainment companies on the planet, including Disney, Netflix, Paramount, Sony, Universal, and Warner Bros. Discovery.

A template for the industry #

The MPA has positioned this MOU as a potential blueprint for future agreements between AI companies and creative industries.

The 2023 SAG-AFTRA strike, which centered partly on AI protections, demonstrated how seriously the creative workforce takes these issues.
