Over 500 localities across 39 states have imposed restrictions on new data center construction as polls show most Americans don't want them nearby
The AI boom needs electricity. Lots of it. And the communities being asked to supply that power are increasingly saying no.
At least 75 data center projects worth roughly $130 billion were blocked or delayed in the first quarter of 2026 alone, as public opposition to the massive facilities hardened into policy across the country. By July 2026, more than 500 localities across 39 states had enacted bans, moratoriums, or other restrictions on new data center development.
A bipartisan NIMBY revolt #
Polling shows that between 61% and 71% of Americans oppose new data centers being built in their communities, a figure that has transformed what was once a quiet zoning issue into a full-blown political flashpoint.
New York Governor Kathy Hochul issued an executive order in July 2026 pausing permits for large data center facilities. Pennsylvania and Texas governors followed with similar mandates. At the federal level, the AI Data Center Moratorium Act was introduced in March 2026, signaling that Congressional attention has caught up with local frustration. Eight states enacted legislation in 2026 specifically rolling back data center tax subsidies, with another 17 states considering similar measures.
The $228 billion problem #
The financial toll extends well beyond that single quarter. Total disruptions linked to community opposition have accumulated to approximately $228 billion when factoring in earlier periods.
For companies like Amazon and Google, which are planning gigawatt-scale campus developments, the math is getting increasingly uncomfortable. These firms had mapped out expansion strategies assuming a relatively frictionless permitting environment, the kind where tax incentives sweetened deals and local governments competed to attract investment. The erosion of tax incentives is a particularly sharp reversal. Data center developers had grown accustomed to generous state and local subsidies: property tax abatements, sales tax exemptions on equipment, and sometimes direct grants.
The industry’s response #
Tech companies aren’t sitting still. Significant lobbying efforts are underway as major players attempt to navigate the new regulatory environment. The industry’s primary argument is straightforward: AI is a national competitiveness issue, and restricting data center construction means ceding ground to China and other rivals building their own computing infrastructure without the same democratic constraints.
Some companies are beginning to voluntarily disclose water usage, energy sourcing, and noise levels in an attempt to rebuild public trust before regulators force their hand.
